Mathews Archery Wins Patent Lawsuit with Bowtech

Matt McPherson, a leading designer and innovator in the archery industry, is pleased to announce that the patent infringement litigation brought by his intellectual property holding company, MCP IP, LLC, against Bowtech, Inc. has been resolved.

Bowtech has admitted that more than 40 of its Bowtech/Diamond-branded bows currently sold and on the market since at least 2011 as well as its Deadlock Lite Octane Quiver infringe 228 claims of the 24 MCP IP patents at issue. Judgment of infringement by Bowtech has been entered by the United States District Court for the District of Oregon to that effect. Judgement-2020.2.26 Bowtech has agreed to a confidential financial settlement for past infringement as well as to take a going-forward license to use certain MCP IP patents for some of its products. The parties’ dispute had been pending in the Oregon Court since November 27, 2017 when MCP IP sued Bowtech, Case Nos. 6:17-cv-01896-MK and 6:18-cv-01087-MK. This litigation has concluded, and the parties have requested that the related proceedings before the United States Patent Trial and Appeal Board, IPR2019-00379, -00380, -00382, -00383, -00386, -00990, and -01013 be terminated. Bowtech’s counterclaims against MCP IP, Mathews Archery, and Mr. and Mrs. McPherson, that were alleged in the Oregon Court, have been dismissed with prejudice.

Numerous MCP IP patents, including the patents involved in the dispute with Bowtech, protect Mathews Archery’s and Mission Archery’s lines of archery equipment. MCP IP continues to pursue additional intellectual property protection for its valuable innovations.
